Please read them carefully. If you do not agree, do not proceed with engaging our services.


1. Services Provided

We provide professional tree services including, but not limited to: tree pruning, trimming, removal, stump grinding/removal, emergency storm work, cabling/bracing, and related consultations or assessments. Services are performed by trained personnel using industry-standard practices.

All services are based on the specific quote/estimate provided to you, which forms part of the agreement. Any changes must be agreed upon in writing.


2. Quotes and Estimates

  • Quotes are based on a visual inspection and information provided by you. Hidden conditions (e.g., decay, utility lines, structural issues) discovered during work may require adjustments to scope and price.
  • A site visit or additional assessment may be required for accurate pricing.


3. Deposits and Payment

  • The balance is due upon completion of the work, unless other payment terms are agreed in writing.
  • Accepted payment methods: [list methods, e.g., e-Transfer, cash, credit card (with possible surcharge), cheque].
  • Late payments may incur interest at 1.5–2% per month (or the maximum allowed by law) and collection costs.
  • All prices are in Canadian dollars (CAD) and do not include applicable taxes unless stated.


4. Scheduling and Delays

  • We will make reasonable efforts to perform services on the agreed date/time.
  • We are not liable for delays due to weather, unsafe conditions, equipment failure, permit delays, utility locates, access issues, or other circumstances beyond our reasonable control (force majeure).
  • If work cannot proceed safely (e.g., high winds, icy conditions, poor access), we may reschedule without penalty.


5. Customer Responsibilities

You agree to:

  • Provide safe, unobstructed access to the work area, including parking and equipment staging.
  • Inform us of any known hazards (e.g., underground utilities, septic systems, pools, hidden structures, bees/wasps, or neighbor disputes).
  • Warrant that you own the property or have full authority/permission to authorize the work.
  • Remove vehicles, personal property, or obstacles from the work zone.

Failure to do so may result in additional charges, rescheduling, or cancellation without refund of deposit.


6. Property and Landscaping

  • Tree work often involves heavy equipment and falling debris. We take reasonable care to minimize damage to lawns, gardens, driveways, fences, and structures.
  • We are not liable for unavoidable or incidental damage to grass, plants, sod, flower beds, paving stones, or other landscaping unless caused by our gross negligence.
  • Cleanup includes removal of major debris from the work area; additional cleanup (e.g., full yard raking or haul-away of wood chips/logs) may incur extra fees.


7. Insurance and Liability

  • We carry commercial general liability insurance and workers’ compensation coverage as required by Manitoba law.
  • Proof of insurance available upon request.
  • Our liability for any damage, loss, or injury is limited to the lesser of the contract price or our available insurance coverage.
  • We are not liable for indirect, consequential, or incidental damages (e.g., loss of use, business interruption, tree disease recurrence, or regrowth issues).
  • You release us from liability for pre-existing conditions, acts of nature, or issues arising after completion.


8. Cancellations and Refunds

  • Cancellations more than 48 hours before the scheduled start may forfeit the deposit.
  • No-shows or same-day cancellations will result in full forfeiture of deposit and possible additional charges.
  • Deposits are non-refundable once scheduling and preparation (e.g., permits, crew allocation) have begun.

9. Wood, Debris, and Ownership

  • Unless otherwise agreed, all cut wood, branches, stumps, and debris become our property upon removal.
  • Options (extra fee may apply): leave firewood on-site, chip and leave mulch, haul away everything.
  • We are not responsible for firewood quality, seasoning, or insects/pests in removed material.


10. Warranties

  • We warrant that services will be performed in a professional, workmanlike manner consistent with industry standards.
  • No other warranties, express or implied, including for tree health post-service or prevention of future issues.


11. Governing Law and Disputes

These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein.

Any disputes arising from our services shall be resolved through negotiation, then mediation, and if necessary, in the courts of Winnipeg, Manitoba.


12. Changes to Terms

We may update these Terms from time to time. The version posted on our website at the time of service applies. Continued engagement of services constitutes acceptance of updates.
